THE EXTENT OF MICHIGAN'S COMPLIANCE WITH FEDERAL REGULATIONS GOVERNING THE CONFIDENTIALITY AND SECURITY OF CRIMINAL HISTORY DATA IS DESCRIBED, AND PLANS FOR ACHIEVING FULL COMPLIANCE ARE SET FORTH.
Abstract
BACKGROUND INFORMATION ON MICHIGAN'S CRIMINAL JUSTICE SYSTEM IS PRESENTED, AND THE ROLES AND RESPONSIBILITIES OF SYSTEM COMPONENTS WITH REGARD TO MAINTAINING THE PRIVACY AND SECURITY OF CRIMINAL HISTORY RECORDS ARE DEFINED. AN ORGANIZATIONAL STRUCTURE FOR PRIVACY AND SECURITY MANAGEMENT IS DESCRIBED AND ILLUSTRATED IN A CHART. OBJECTIVES, FEDERAL REQUIREMENTS, COMPLIANCE STATUS, AND PROPOSED ACTIONS ARE SET FORTH RELATIVE TO DATA COMPLETENESS AND ACCURACY, LIMITATIONS ON DISSEMINATION, INDIVIDUAL ACCESS AND REVIEW, AUDIT AND PENALTIES, AND SECURITY. A SCHEDULE FOR IMPLEMENTING THE PLAN IS ACCOMPANIED BY AN ESTIMATE OF IMPLEMENTATION COSTS. SAMPLE COPIES OF AGREEMENTS AND OTHER SUPPORTING DOCUMENTATION ARE INCORPORATED THROUGHOUT THE TEXT. THE CERTIFICATION OF COMPLIANCE STATEMENT FOR MICHIGAN'S CENTRAL REPOSITORY IS INCLUDED.
