This book, intended primarily for military and civilian attorneys whose practice includes military justice, presents procedural and substantive rules pertaining to military court martial, along with military acronyms and related disciplinary practices unique to military criminal law.
Abstract
The book emphasizes the practical aspects of handling criminal justice problems within the military. The material, with minor exceptions, follows the flow of a case from pretrial investigation through appellate disposition. Following a review of the history and current system of military criminal justice, chapters focus on such topics as military crimes, nonjudicial punishment, jurisdiction, the commander's investigation and pretrial restraints, and the preferral and forwarding of charges. Some pretrial procedures discussed are plea negotiations; notice, disclosure, and discover; the pretrial session; motions practice; and pleas. A discussion of trial procedures includes the production of witnesses and evidence. A discussion of the review of courts martial concludes the book. Appended forms, tables, rules, and guides; chapter annotated bibliographies; a table of cases; and subject index.
