Abstract
ISSUES IN SUBSTANTIVE LAW THAT AFFECT MILITARY JUSTICE ARE ACCUSATIONS, CHARGES AND SPECIFICATIONS, PLEAS, AND MULTIPLICITY OF CHARGES. ABSENCE OFFENSES PERTAIN TO UNAUTHORIZED ABSENCES, FAILURE TO REPORT AT THE APPOINTED PLACE OF DUTY, GOING FROM THE APPOINTED PLACE OF DUTY, ABSENCE FROM A UNIT OR ORGANIZATION, AGGRAVATED FORMS OF UNAUTHORIZED ABSENCE, AFFIRMATIVE DEFENSES TO UNAUTHORIZED ABSENCES, DESERTION, THE MISSING MOVEMENT, AND THE RELATIONSHIP BETWEEN UNAUTHORIZED ABSENCE AND DESERTION. OFFENSES AGAINST PERSONS IN AUTHORITY DEAL WITH LAWFULNESS, VIOLATION OF GENERAL ORDERS AND REGULATIONS, DERELICTION IN THE PERFORMANCE OF DUTIES, WILLFUL DISOBEDIENCE OF A SUPERIOR'S ORDERS, AFFIRMATIVE DEFENSES TO VIOLATIONS OF ORDERS, AND DISRESPECT OF SUPERIORS. OFFENSES AGAINST PERSONS IN GENERAL CONCERN ASSAULT AND BATTERY, SIMPLE ASSAULT, ASSAULT CONSUMMATED BY BATTERY, ASSAULT WITH A DANGEROUS WEAPON OR OTHER MEANS LIKELY TO PRODUCE DEATH OR GRIEVOUS BODILY HARM, INTENTIONAL INFLICTION OF GRIEVIOUS BODILY HARM, ASSAULT UPON SUPERIORS, AND AFFIRMATIVE DEFENSES TO ALL FORMS OF ASSAULT. OFFENSES AGAINST PROPERTY RELATE TO LARCENY AND WRONGFUL APPROPRIATION, ROBBERY, RECEIVING OR CONCEALING STOLEN PROPERTY, BAD CHECKS, MILITARY PROPERTY OF THE FEDERAL GOVERNMENT AND NONMILITARY PROPERTY, AND HOUSEBREAKING.
