This study guide, the primary resource for the military justice procedure course at the Naval Justice School in Newport, R.I., details case processing procedures in the military justice system.
Abstract
The described procedures encompass the initiation of a complaint against a service member through the court-martial appellate review process. Pretrial and nontrial matters discussed include investigations, informal disciplinary actions, nonjudicial punishment, jurisdiction, the convening of courts-martial, pretrial agreements, and pretrial detention. Trial issues discussed include the speedy trial, the summary court-martial, trial procedures, voir dire and challenges, and deliberation and punishment. In addition to describing review procedures for courts-martial, the manual also discusses extraordinary relief through the use of petitions for writs to the U.S. Court of Military Appeals. The procedures presented are those found in the Uniform Code of Military Justice, the Manual for Courts-Martial, 1984, and the Manual of the Judge Advocate General of the Navy.
