This report lists the States with a minimum statutory age limit for capital punishment, with minimum statutory age for any criminal court jurisdiction, and with and without statutory specification of age as a mitigating factor in a capital offense.
Abstract
Of the 36 jurisdictions currently (March 1986) having valid capital punishment statutes, 27 set minimum ages ranging from 18 to 10. Of the nine jurisdictions without a minimum age, six expressly provide for age as a mitigating factor in the death sentencing decision.
