MISSISSIPPI'S COURT SYSTEM IS DESCRIBED IN ONE OF A SERIES OF PROFILES PREPARED BY THE NATIONAL CENTER FOR STATE COURTS TO FACILITATE IMPLEMENTATION OF AMERICAN BAR ASSOCIATION (ABA) STANDARDS ON COURT ORGANIZATION.
Abstract
THE REPORT, WHICH IS BASED ON A REVIEW OF THE STATE'S CONSTITUTION, STATUTES, COURT RULES, ANNUAL COURT REPORTS, AND ADMINISTRATIVE MANUALS, IS IN THREE PARTS: AN OVERVIEW, CHARTS, AND PROFILES. THE OVERVIEW SUMMARIZES INFORMATION ON THE FOLLOWING: COURT STRUCTURE (APPELLATE AND TRIAL COURTS); JUDICIARY (QUALIFICATIONS, SELECTION, TERMS, DISCIPLINE, REMOVAL, COMPENSATION, RETIREMENT AGE, CONTINUING EDUCATION, PARAJUDICIAL OFFICERS); ADMINISTRATION AND PROCEDURE (ADMINISTRATIVE AUTHORITY, STATE AND COURT LEVEL ADMINISTRATION, POLICYMAKING AND RULEMAKING AUTHORITY, NONJUDICIAL PERSONNEL); FINANCE AND BUDGET (FUNDING, FINES AND FEES, BUDGETING PROCEDURES); AND INFORMATION SYSTEMS (RECORDKEEPING, STATISTICS, DATA PROCESSING). THE EXTENT TO WHICH EACH ASPECT OF THE COURT SYSTEM COMPLIES WITH ABA STANDARDS IS NOTED. CHARTS DEPICT MISSISSIPPI COURT ORGANIZATION, JURISDICTIONS, AND FUNDING SOURCES. DETAILED INFORMATION ON EACH ASPECT OF COURT OPERATIONS COVERED IN THE OVERVIEW IS PRESENTED IN A SERIES OF PROFILES. THE PROFILES ARE CROSS INDEXED TO A CHART INDICATING THE DEGREE OF SIMILARITY BETWEEN THE MISSISSIPPI COURT SYSTEM AND EACH ABA STANDARD. SOURCE DOCUMENTS ARE LISTED. (LKM)
