The booklet presents a model policy for police departments to follow regarding interrogation of suspects and provides detailed discussions, including background information and analyses of court precedents, related to each aspect of the policy.
Abstract
The analysis discusses those situations when a police officer must advise individuals of their rights as well as situations when it is not required. Additional sections explain the waiver of Miranda rights for adults and juveniles, the preservation of proof of a waiver, what to do when suspects assert their rights, the emergency to Miranda, and steps to take after the suspect has been charged. Appended Miranda card, form for waiver of rights, and statement reaffirming waiver if a written confession or statement is subsequently received.
