This manual presents 1980 model rules for Texas peace officers.
Abstract
Although the manual contains carefully analyzed and drafted model rules, it is intended as an advisory research resource for key agency administrators to use in developing directives tailored to local needs. To assist in this process, one section discusses the design, implementation, enforcement, and updating of written rules and procedures. A model rulemaking procedure is described. In presenting model rules for domestic disturbances, a general procedure is outlined, followed by detailed rules on entry and intervention on private premises, nonarrest remedies, physical assaults, and other related offenses. Rules are presented for operating procedures in misdemeanor field release by citation, including rules for completing the written notice to appear. Sample citation forms are provided. Following a discussion of general policies and procedures for the use of force, rules are provided on the use of deadly and nondeadly force, reporting the use of force, and an officer's record of firearms. In addition to providing rules for police intervention in child abuse cases, guidance is also provided on reporting child abuse and neglect, responding to reports of child abuse, identification of child abuse and neglect, emergency removal of a child from the home, and criminal investigations. Model rules are also provided for warrantless arrest, warrantless search and seizure, execution of arrest warrants and search warrants, stop and frisk, handling rape cases, emergency driving, handling mentally ill persons, disorderly conduct, eyewitness identifications, control of criminal justice information, conduct and performance, and departmental review and discipline.
