This is the 2011 revised edition of the Model Tribal Sex Offender Registration Code/Ordinance, which contains language that complies with the provisions of the Federal Sex Offender Registration and Notification Act (SORNA), including supplemental guidelines and additions of the Tribal Law and Order Act (TOLA).
Abstract
In providing this revision, the U.S. Justice Department's Office of Sex Offender Sentencing, Monitoring, Apprehending, Registering, and Tracking (SMART), which administers the implementation of SORNA, advises that tribes are to view this model law only as a guide and a source of information that each tribe should consider in determining how to comply with SORNA. This document does indicate, however, what tribes must do in order to comply with the implementation of SORNA's provisions. It also includes notes highlighted in bold text that are intended to motivate tribal leaders to consider other relevant issues as they meet to discuss potential code/ordinance development. The eight chapters of this document address general matters, terminology and registerable offenses, tiering of offenses, required information, registration logistics, the public sex offender registry website, immunity, and crimes and civil sanctions.
