A DESCRIPTION OF PROVISIONS AND APPLICATIONS OF THE CHILD WELFARE AND YOUTH WELFARE LAWS WITH RESPECT TO JURISDICTION OVER JUVENILES AND YOUNG ADULTS, MEASURES AVAILABLE TO THE COURT, AND TYPES OF JUVENILE COURTS.
Abstract
IN GERMANY, CHILDREN UNDER IN YEARS OF AGE ARE NOT RESPONSIBLE BEFORE THE LAW. INDIVIDUALS UNDER 21 ARE REGARDED AS MINORS - JUVENILES (BETWEEN THE AGES OF 14 AND 17) AND YOUNG PERSONS BETWEEN 18 AND 21 BUT DO HAVE RESPONSIBILITY BEFORE THE LAW. IN DEALING WITH JUVENILES AND YOUNG PERSONS THE COURTS MAY APPLY EDUCATIONAL MEASURES, MILD DISCIPLINARY MEASURES, OR JUVENILE SANCTIONS WHICH ARE PUNISHMENTS IN THE LEGAL SENSE EXCEPT THAT NO PERMANENT RECORD OF THE SANCTION IS KEPT. THERE ARE THREE TYPES OF JUVENILE COURTS - THE JUVENILE JUDGE, THE JUVENILE JURY, AND THE JUVENILE SECTION OF THE ADULT COURT. THE FUNCTION AND JURISDICTION OF EACH ARE DESCRIBED.
