This handbook presents an overview of the Juvenile Justice and Delinquency Prevention Act of 1974 as Amended (JJDP Act) and the Montana Youth Court Act for the purposes of maintaining compliance.
Abstract
Main goals of the JJDP Act include the deinstitutionalization of status and non-offenders; separation of adult and youth offenders in institutions; removal of juveniles from adult jails and lockups; a reduction in the disproportionate minority contact with the juvenile justice system; and compliance monitoring of jails and all juvenile detention, correctional, and non-secure facilities. Each of these goals is discussed in turn, including the intent of each goal and any exceptions to the requirement. Regulations governing juvenile offender waivers to adult court and direct filing of juveniles in adult court are examined in light of the goal of maintaining juvenile inmates separately from adult inmates. Juvenile facility regulations are reviewed, followed by a listing of available technical assistance and training for JJSP Act compliance. Quick reference tables are offered for the types of facilities to be monitored under the JJSP Act and for custody requirements by most restrictive regulation. Appendixes contain information on valid court order exceptions, the decision tree for handling interstate compact youth in Montana, and the Montana Youth Court Act. Tables, footnotes, appendixes
