A STATUTE-BY-STATUTE COMMENTARY, DATED AUGUST 1973, OF THE MONTANA YOUTH ACT DRAFT, WHICH REVISES PROVISIONS FOR JUVENILE CASES.
Abstract
THE REPORT FIRST PRESENTS A SUMMARY OF NATIONAL AND MONTANA BACKGROUND INFORMATION ON THE RATIONALES, NEEDS, AND GOALS FOR A JUVENILE JUSTICE SYSTEM. THE PROPOSED LEGISLATION IS ANALYZED FROM A LEGAL VIEWPOINT AND THEN FROM A TREATMENT ORIENTATION. CONSULTANT'S CRITICISMS OF THE LEGISLATION INCLUDE CONCERNS THAT THE PROPOSALS ARE MORE PUNITIVE THAN POSITIVE, THAT JUVENILES MAY BECOME LABELED BY THE LEGAL TERMINOLOGY, THAT LEGAL CUSTODY OF JUVENILES IS TOO EASILY TAKEN AWAY FROM THE PARENTS, AND THAT A CITIZEN COMMITTEE ADJUNCT TO THE JUVENILE COURTS IS NOT PROVIDED FOR.
