A LAW WAS PASSED BY THE SECOND CHAMBER OF THE DUTCH, STATES GENERAL ON JANUARY 1, 1974, MAKING CERTAIN CHANGES IN DETENTION PENDING INVESTIGATION, THE INTERROGATION OF SUSPECTS AND A SUSPECT'S RIGHT TO COUNSEL.
Abstract
THE NEW LAW LIMITS DETENTION PENDING INVESTIGATION FOR SUSPECTS IN CRIMINAL CASES TO A TOTAL OF 102 DAYS. FURTHERMORE, TIME SPENT IN DETENTION PENDING INVESTIGATION MUST BE SUBTRACTED FROM THE OFFENDER'S SENTENCE AND THE SECRETARY OF THE REHABILITATION COUNCIL MUST BE NOTIFIED OF DETENTION OF A SUSPECT BY THE POLICE SO THAT REHABILITATION WORK CAN BEGIN EARLY. ALSO, THE NEW LAW PROVIDES FOR ASSIGNMENT OF COUNSEL BY THE JUDGE, IF NECESSARY, AND A SUSPECT IS NO LONGER REQUIRED TO ANSWER QUESTIONS DURING HIS INTERROGATION. THUS, A SUSPECT NOW HAS MORE RIGHTS THAN FORMERLY. HOWEVER, CERTAIN PROVISIONS REGARDING SUSPENSION OF THE INVESTIGATION MAKE IT POSSIBLE THAT A SUSPECT WILL HAVE TO REMAIN IN DETENTION PENDING INVESTIGATION LONGER THAN PREVIOUSLY, AND IN THIS WAY HIS POSITION HAS BECOME WORSE. --IN DUTCH
