This analysis of abductions by parents across international boundaries considers the international conventions and United States law designed to address the problem and offers advice for parents and attorneys involved in an international case.
Abstract
All States' passage of the Uniform Child Custody Jurisdiction Act in 1968 and the Federal Parental Kidnapping Prevention Act have established consistent laws in the United States. In addition, two international conventions are designed to address many of the problems associated with child abduction by a noncustodial parent. Attorneys involved in these cases need to be aware that successful litigation of an international abduction case requires a thorough understanding of the legal mechanisms contained in current international treaties. Where no treaty is in force, it is necessary to obtain the assistance of various legal and governmental organizations that offer services relating to the location of an abducted child, determination of applicable foreign law, and obtaining of aid from foreign counsel.
