This manual, based on site visits, a questionnaire survey, and a review of statutory and case law developments, explains the recommended procedures to be followed by judges and court clerks in Texas municipal courts.
Abstract
Following an introduction to the judicial process, legal authority and jurisdiction are examined; the organization of the court and its relations with other city departments are delineated. The selection, roles, responsibilities, compensation, and removal of court officers (presiding judge, judge, court clerk, city prosecutor, bailiff, warrant officer, and court reporter) are reviewed. The requirements and content of court complaints also are considered. Processing procedures are outlined for traffic and nontraffic and city ordinance violations, citizen complaints, and parking citations. Docketing, issuing subpoenas, and pretrial and court procedures then are elucidated. Jury and nonjury trial procedures are described; as are the laws of evidence, elements of cases, and case disposition. Additional areas considered include magistrate functions, finance, records, facilities and equipment, and interagency cooperation. References to specific legal citations and rules are made throughout the text. Appendixes include a glossary and additional information on judge's introductory statements, forms, and triable traffic law violations. Chapter footnotes, illustrations, and index.
