CRITIQUE OF THE STUDY GROUP ON THE CASELOAD OF THE SUPREME COURT WHICH CONTENDS THAT THE PROPOSED NATIONAL COURT OF APPEALS WOULD JEOPARDIZE THE SUPREME COURT.
Abstract
THE AUTHOR ACCUSES THE STUDY GROUP REPORT OF UNCRITICAL HANDLING OF WORKLOAD STATISTICS AND OF IGNORING OR OF LEAVING UNANSWERED CRUCIAL QUESTIONS ON WAYS TO CONTROL THE COURT DOCKET. THIS ARTICLE CONSIDERS THE CONSTITUTIONAL IMPLICATIONS OF CHANGING OR DELEGATING THE REVIEW POWERS OF THE SUPREME COURT. FOR AN OPPOSING POINT OF VIEW SEE NCJ-009420.
