These 1984 survey results provide nationwide data on types of indigent defense systems, funding sources, costs, and caseloads.
Abstract
A stratified sample was developed for the survey based on county population size as reported in the 1980 census. Survey packages were mailed to 510 county respondents and 797 program respondents. The sampling plan provided a representative sample of jurisdictions around the country, and the two-stage data collection process using both mail surveys and telephone followup yielded high response rates, including 99 percent completed county questionnaires. Information gathered on the types and characteristics of indigent defense systems covers the organization and structure of services both nationally and State-by-State. County system types are classified to estimate the frequency with which public defender, assigned counsel, and contract systems are used. Descriptive system information is presented, with differences by region or community size highlighted. Indigent defense expenditures and caseload are analyzed nationally and State-by-State, with total costs and amounts contributed by each source indicated. Per capita analyses are provided for each State and the four regions. A discussion of features of case processing common to all systems focuses on indigency screening, recoupment, early representation, and appointment of separate counsel for codefendants. Changes in the structure and funding of services are summarized. Graphic and tabular data and questionnaires.
