A NATIONAL PROGRAM IS PROPOSED TO IDENTIFY AND TRAIN A NEW GENERATION OF ARBITRATORS, INCLUDING A SIGNIFICANT NUMBER OF WOMEN AND MINORITIES, TO MEET GROWING DEMANDS FOR ARBITRATORS IN THE PUBLIC AND PRIVATE SECTORS.
Abstract
SURVEY EVIDENCE INDICATES THAT IN GRIEVANCE ARBITATION, THE PARTIES TO A DISPUTE HAVE CONTINUED TO CONCENTRATE ON USING A DIMINISHING NUMBER OF OLDER, MORE ESTABLISHED ARBITRATORS (OR NEUTRALS), DESPITE THE FACT THAT MANY QUALIFIED ALTHOUGH YOUNGER AND UNTRIED NAMES APPEAR ON THE ROSTERS OF THE FEDERAL MEDIATION AND CONCILIATION SERVICE, THE NATIONAL MEDIATION BOARD, AND THE AMERICAN ARBITRATION ASSOCIATION. THEREFORE, THERE IS A DUAL NEED OF INCREASING THE ACCEPTABILITY OF QUALIFIED BUT UNUSED NEUTRALS FOR THE RAPIDLY EXPANDING NUMBER OF ARBITRATION CASES IN BOTH THE PRIVATE AND PUBLIC SECTORS. IT IS RECOMMENDED THAT A NATIONAL ADVISORY COMMITTEE BE ESTABLISHED THAT WOULD CONSIST OF TWO OR THREE REPRESENTATIVES FROM EACH OF TEN CITIES. IMMEDIATE TASKS WOULD INCLUDE ASCERTAINING AVAILABIITY AND ENCOURAGING THE INTEREST OF QUALIFIED NEUTRAL TO SERVE AS ON-THE-JOB TRAINERS, AND DEVELOPING A MEMBERSHIP OF LOCAL ADVISORY COMMITTEES. THE GOAL IS A NATIONWIDE TRAINING PROGRAM TO BE LAUNCHED BY A SERIES OF TWO AND ONE-HALF DAY CONFERENCES IN EACH OF THE TEN CITIES. INFORMATION IS PROVIDED ON THE FORMAT, LOCATIONS, PARTICIPANT SELECTION CRITERIA AND COSTS OF THE INITIAL AND THE MORE INTENSIVE FOLLOW-UP TRAINING SESSIONS. APPENDICES INCLUDE: 1) A TENTATIVE LIST OF MEMBERSHIP OF THE NATIONAL ADVISORY COMMITTEE, AND 2) A PRELIMINARY BUDGET FOR A NATIONAL NEUTRAL TRAINING PROGRAM--FRO BOTH THE INITIAL AND FOLLOW-UP STAGES.
