THIS ARTICLE EXAMINES THE PROBLEM OF RECORDING WITNESS STATEMENTS AND TESTIMONY TO ENSURE THAT WHAT IS TRANSCRIBED AND REPORTED IS A FAITHFUL AND TRUE REPRESENTATION OF THE FORM AND SUBSTANCE OF WHAT IS SAID.
Abstract
IT FOCUSES ON THE ISSUES RELATING TO THE NEED TO RECORD NOT ONLY WITNESS/SUSPECT RESPONSES, BUT INTERROGATOR QUESTIONS AS WELL; THE IMPORTANCE OF TRANSCRIBING THE EXACT WORDS AND EXPRESSIONS USED IN STATEMENTS (AS OPPOSED TO EDITED APPROXIMATIONS); AND THE SIGNIFICANCE OF NOTING THE TONE AND DEMEANOR OF THE INTERROGATOR AS WELL AS THE WITNESS/SUSPECT, IN ADDITION TO THE CONTEXT OF BOTH QUESTIONS AND RESPONSES.
