THIS REPORT PRESENTS NEVADA'S PLAN FOR IMPLEMENTING FEDERAL LEGISLATION CONCERNING PRIVACY AND SECURITY OF CRIMINAL RECORDS.
Abstract
THE OBJECTIVES OF NEVADA'S PROGRAM ARE TO PROTECT THE PRIVACY OF RECORDS, INSURE THEIR ACCURACY AND COMPLETENESS, AND PROVIDE ACCESS TO CRIMINAL HISTORY INFORMATION TO ALL ORGANIZATIONS AND INDIVIDUALS WITH A JUSTIFIABLE NEED TO KNOW. MANY REQUIREMENTS OF THE FEDERAL LEGISLATION ARE ALREADY INCLUDED IN THE STATE'S COMPREHENSIVE DATA SYSTEMS PROGRAM, INCLUDING ACCURATE AND TIMELY REPORTING OF STATISTICS AND MONITORING AND EVALUATION PROCEDURES. CRIMINAL HISTORY INFORMATION WITH A CONVICTION DISPOSITION WILL BE DISSEMINATED BY THE STATE AT ITS DISCRETION, BUT NONCONVICTION RECORD INFORMATION WILL BE DISTRIBUTED ON A LIMITED BASIS SUBJECT TO FEDERAL REGULATIONS. SECURITY MEASURES WOULD PREVENT UNAUTHORIZED ACCESS TO COMPUTERIZED DATA AND STORAGE AREAS. AN APPEAL BOARD WILL BE RESPONSIBLE FOR REVIEWING CRIMINAL RECORD APPEALS AND CHALLENGES AFTER REVIEW BY THE AGENCY THAT ORIGINATED THE RECORD, WITH THE NEVADA CRIME COMMISSION SERVING AS THE FINAL APPEAL BODY. THE NEVADA CRIME COMMISSION WOULD BE RESPONSIBLE FOR PLAN ADMINISTRATION. A GLOSSARY OF TERMS IS PROVIDED, AND APPENDIXES CONTAIN A SUMMARY OF NEVADA'S CRIMINAL JUSTICE SYSTEM PLAN, THE SCHEDULE FOLLOWED IN COMPUTERIZING CRIMINAL HISTORY INFORMATION, COST ANALYSIS OF THE PRIVACY PLAN, A COPY OF NEVADA'S CERTIFICATION FORM FOR COMPLYING WITH FEDERAL REGULATIONS, AND RELEVANT STATE STATUTES CONCERNING THE COMMISSION ON CRIME, DELINQUENCY, AND CORRECTIONS, SEALING RECORDS AFTER CONVICTIONS, AND JUVENILE CASE PROCEDURES.
