Abstract
THIS EMPIRICAL STUDY EMPHASIZES THAT EXCLUSION OF JURORS WHO OPPOSE THE DEATH PENALTY IN CAPITAL CASES BIASES THE GUILT DETERMINING PROCESS AND RESULTS IN A CONVICTION PRONE JURY. DATA PRESENTED TO SUPPORT THE HYPOTHESIS, AND INFORMATION IS PROVIDED ON GENERAL FUNCTIONING OF THE JURY.
