A DESCRIPTION OF THE SYSTEM OF PENAL GUARDIANSHIP, INITIATED IN FRANCE IN 1970, IN WHICH HABITUAL OFFENDERS MAY BE SENTENCED TO AN ADDITIONAL PERIOD OF CORRECTIONAL SUPERVISION TO BE SERVED AFTER THEIR ORIGINAL SENTENCE.
Abstract
THE AUTHOR STRESSES THE INNOVATIVE NATURE OF THIS SYSTEM, WHICH REPLACES THE FORMER SYSTEM OF EXILE OF HABITUAL OFFENDERS. HE MAINTAINS THAT SUCH A SYSTEM IS CONSISTENT WITH THE CURRENT REHABILITATIVE ORIENTATION IN CORRECTIONS, SINCE THE TERM OF PENAL GUARDIANSHIP IS TO BE USED TO PREPARE THE INMATE FOR REINTEGRATION WITH SOCIETY THROUGH INDIVIDUALIZED TREATMENT. THE USE OF PENAL GUARDIANSHIP MAY ONLY BE INVOKED FOR CERTAIN SERIOUS, HABITUAL OFFENDERS. THE PERIOD OF PENAL GUARDIANSHIP IS USUALLY FOR TEN YEARS; HOWEVER, THE LENGTH OF GUARDIANSHIP MAY BE REDUCED IN SOME CASES. THE AUTHOR NOTES THAT PENAL GUARDIANSHIP IS COMPLEMENTARY TO THE MAIN SENTENCE, AND MAY BE INITIATED EITHER UPON COMPLETION OF THE ORIGINAL SENTENCE OR DURING THE COURSE OF THE ORIGINAL SENTENCE. FINALLY, THE TERM OF PENAL GUARDIANSHIP MAY BE SERVED IN CLOSED INSTITUTIONS, COMMUNITY-BASED INSTITUTIONS, OR WHILE THE OFFENDER IS ON PAROLE. --IN SPANISH
