A GENERAL GUIDE TO THE FUNCTIONS AND STRUCTURE OF THE JUDICIARY SYSTEM OF NEW HAMPSHIRE, THIS BROCHURE IS DESIGNED TO BE A TOOL FOR THE FRENCH-SPEAKING PUBLIC.
Abstract
THE CONSTITUTIONAL BASIS FOR THE SUPREME, SUPERIOR, AND PROBATE COURTS IN NEW HAMPSHIRE IS EXPLAINED, ALONG WITH LEGISLATION GOVERNING LOCAL AND MUNICIPAL COURTS. THE DISTINCTIONS BETWEEN CIVIL AND CRIMINAL CODES ARE PRESENTED WITH A CASE EXAMPLE; SUPERIOR COURT PROCESSES REGARDING CRIMINAL SUITS ARE BROKEN DOWN INTO THE ACCUSATION, THE GRAND JURY, THE ARREST PROCEDURE, THE ARRAIGNMENT, PLEA BARGAINING, AND TRIAL PREPARATION. INFORMATION ON WHICH COURT SHOULD BE CONTACTED IN CERTAIN SITUATIONS IS INCLUDED. THE ROLE OF JUDGES, THE USE OF THE ADVERSARY SYSTEM, AND INSTANCES FOR RECOURSE TO THE FEDERAL COURT ARE DESCRIBED. TRIAL BY JURY IN THE SUPERIOR COURTS IS EXPLAINED. FINALLY, THE ROSTER OF COURT PERSONNEL IS PRESENTED.
