A UNIFORM GUIDE, DEVELOPED EXPRESSLY FOR JUVENILE OFFICERS, DEVOTED EXCLUSIVELY TO THE PROBLEMS AND PROCEDURES UNIQUE TO THE JUVENILE JUSTICE SYSTEM IN NEW JERSEY IS PRESENTED.
Abstract
THE MANUAL IS DESIGNED TO IMPROVE THE OFFICERS' UNDERSTANDING OF THE SYSTEM, IMPROVE COMMUNICATION BETWEEN POLICYMAKERS AND IMPLEMENTERS, AND CREATE UNIFORM ADHERENCE TO EXISTING POLICIES AND LAWS. IT IS DIVIDED INTO SEVERAL MAJOR SECTIONS WITH SUPPLEMENTARY APPENDIXES. IN THE FIRST SECTION, THE PHILOSOPHY OF JUVENILE JUSTICE IS DISCUSSED, FOCUSING ON THE REHABILITATIVE IDEAL, THE MODERN APPROACH, AND TRADITIONAL VERSUS MODERN CONCEPTS. SECONDLY, THE JUVENILE STATUTE AND COURT RULES INCLUDING STATUTE PURPOSE, JURISDICTION, VENUE, AND PROCEDURAL AND CONSTITUTIONAL RIGHTS ARE PRESENTED. THE SECTION ON THE INVESTIGATION OF CASES INVOLVING JUVENILES EXPLAINS SUCH TOPICS AS GENERAL INVESTIGATIVE PROCEDURES, FINGERPRINTING, PHOTOGRAPHING, AND INFORMATION EXCHANGE WITH OTHER LAW ENFORCEMENT AGENCIES. INTERROGATION OF JUVENILES AND TAKING JUVENILES INTO CUSTODY ARE THE SUBJECTS OF SEPARATE SECTIONS. SEARCHES AND SEIZURES FOCUS ON WARRANTLESS SEARCHES, SEARCH BASED ON CONSENT, STOP AND FRISK, AND AUTOMOBILE SEARCHES. IN SECTION VII POLICE DIVERSION OF JUVENILES IS DESCRIBED. SECTION VIII INVOLVES FAMILY INTAKE AND HIGHLIGHTS THE INTAKE CONFERENCE AS WELL AS THE JUVENILE CONFERENCE COMMITTEE. SECTION IX COVERS THE JUDICIAL PROCESS, THE ROLE OF THE POLICE AND THE COURTS, DEALING WITH SUCH TOPICS AS DETENTION-SHELTER-CARE HEARINGS, WAIVER HEARINGS, ADJUDICATORY HEARINGS, DISPOSITION HEARINGS, AND DELINQUENCY CASES. REGULATIONS CONCERNING CONFIDENTIALITY-DISCLOSURE OF RECORDS ARE DESCRIBED IN SECTION X. FINALLY, SPECIAL LEGAL PROBLEMS RELATING TO CHILD ABUSE ARE DISCUSSED AND INSTRUCTIONS ARE GIVEN TO HELP OFFICERS IDENTIFY CASES OF CHILD ABUSE. APPENDIXES ARE PROVIDED. (LWM)
