This report summarizes the changes made by a new Wisconsin law on driving under the influence of an intoxicant, drugs, or both and on operating a motor vehicle after revocation or suspension of a person's motor vehicle operating privileges.
Abstract
The new law includes a provision for administrative suspension of a driver's license for 6 months if the blood alcohol concentration is found to be 0.1 percent or more and for prohibiting any level of blood alcohol in a person under age 19. In addition, the new law sets a standard of 0.08 percent blood alcohol concentration for persons with two or more convictions, suspensions, or revocations related to drunk driving within a 5-year period. Other provisions relate to penalties for causing death while driving drunk, vehicle seizure and forfeiture, ignition interlock devices, sentencing options, and other matters.
