THE STATISTICAL ANALYSIS AND EVALUATION CENTER OF THE NEW MEXICO CRIMINAL JUSTICE DEPARTMENT PREPARED THIS GUIDE TO INFORM PUBLIC AGENCIES ABOUT PRIVACY AND SECURITY LAWS AND REGULATIONS TO WHICH THEY ARE SUBJECT.
Abstract
IT PRESENTS BACKGROUND INFORMATION ON WHY INFORMATION IS REGULATED, LISTS THE 10 FEDERAL AND STATE (NEW MEXICO) STATUTES AND REGULATIONS UNDER WHICH CRIMINAL JUSTICE INFORMATION IS REGULATED, PRESENTS 10 CHECKLISTS TO DETERMINE IF A PUBLIC AGENCY DEALS WITH SOME FORM OF REGULATED INFORMATION AND IS SUBSEQUENTLY SUBJECT TO THESE REGULATIONS, AND PRESENTS THE STEPS AN AGENCY MUST TAKE TO ASSURE COMPLIANCE WITH APPLICABLE REGULATIONS. SINCE THE PAMPHLET IS MODULAR, AN AGENCY NEED NOT USE ANY PART NOT DIRECTLY APPLICABLE TO ITS OPERATIONS. THE REGULATIONS AND STATUTES DISCUSSED ARE CURRENT AS OF MARCH 1979, AND ARE EITHER DIRECTLY QUOTED OR CLOSELY PARAPHRASED. HOWEVER, THE INTERPRETATIONS PRESENTED DO NOT CARRY LEGAL WEIGHT. (TAG)
