THIS REPORT, WHICH IS BASED ON INTERVIEWS WITH PERSONS WITH VARIOUS KINDS OF EXPERIENCE IN GRAND JURY 'LEAKS' AS WELL AS EXPERIENCES OF OTHER JURISDICTIONS, OUTLINES COMMON SOURCES OF LEAKS AND RECOMMENDS CORRECTIVE ACTION.
Abstract
IT IS RECOMMENDED THAT PROSECUTORS OBTAIN AFFIDAVITS FROM ALL THOSE GOVERNMENT EMPLOYEES, INCLUDING THEIR OWN STAFFS, WHO HAD ACCESS TO LEAKED INFORMATION. THE JUDICIARY, IN ITS SUPERVISORY CAPACITY, IS URGED TO SET GUIDELINES FOR DEALING WITH LEAKS, AND TO HEAR MOTIONS DEALING WITH GRAND JURY APPEARANCES 'IN CAMERA' WHEN REQUESTED. THE BAR ASSOCIATION COULD USE ITS DISCIPLINARY POWERS TO DEAL WITH DISCLOSURES BY ATTORNEYS AND PROSECUTORS. THE PRESS HAS A RESPONSIBILITY TO WEIGH CAREFULLY THE PUBLIC'S RIGHT TO KNOW AGAINST THE INDIVIDUAL'S RIGHT TO PRIVACY AND PRESUMPTION OF INNOCENCE. VARIOUS LEGISLATIVE RECOMMENDATIONS ARE ALSO MADE. APPENDIXES INCLUDE RELATED STATE AND FEDERAL STATUTES.
