This is a guidebook for North Carolina substantive criminal law and is designed primarily to assist law enforcement officers decide which offense should be charged, if any, and what evidence should be gathered to prepare a case for trial.
Abstract
This fifth edition incorporated statutory changes made through the 2000 session of the General Assembly and case law through volume 352 of the North Carolina Reports and volume 139 of the North Carolina Court of Appeals Reports. The guidebook attempts to cover all the criminal offenses that law enforcement officers may encounter in North Carolina, except for offenses in such special subjects as motor vehicle law, alcoholic beverage control law, and fish and game law. The book has introductory chapters on states of mind, defenses, participants in crime, and punishment under structured sentencing and separate chapters on various major categories of offenses. The material on each offense within a category is divided into five sections: (1) the statute, if any, dealing with the offense; (2) the elements of the offense; (3) the punishment for the offense; (4) notes on legal points about the case law concerning the offense that are not evident in the listing of elements; and (5) the names of related offenses not in the chapter. The book does not attempt to give complete legal authority for every point made, but it does cite some legal authorities to be used as starting points for those who might want to look further.
