Legislation has been enacted in North Dakota that established the Bureau of Criminal Investigation (BCI) and that contains provisions on access to public and criminal records, and policies and procedures governing the maintenance of criminal history record information.
Abstract
The BCI is responsible for criminal investigation, which involves determining the offender's criminal record; reporting the offender transfer, release, or disposition; and maintaining criminal history record information (CHRI). Legislation stipulates that citizens generally have access to public records. Further, North Dakota's Criminal History Records Law contains policies and procedures for collecting, maintaining, exchanging, auditing, and disseminating CHRI and for ensuring CHRI security. Legislation also covers the use of CHRI for research and statistics and contains provisions for purging and sealing CHRI.
