Following an introduction that reviews the history and contents of the Norwegian Penal Code, enacted in 1902 and amended in 1961, this book presents an English translation of the code.
Abstract
The General Part of the code contains provisions on the scope of Norwegian penal law, penal and correctional measures, self-defense and defense of others as well as property, mens rea, and responsibility. Only acts committed intentionally or by negligence are punishable. Often a special purpose is also required, particularly the purpose of obtaining an unlawful gain for oneself or another. A person who has acted while "insane" or "unconscious" may not be punished. The second part of the code delineates all felony offenses and their sanctions. There are 24 categories of felonies. The code does not provide for capital punishment or indefinite sentences. Imprisonment may be imposed for a specific period of time, from 21 days up to 15 years, or in certain cases up to 20 years. Some of the most serious felonies are punishable by life in prison. The third part of the code specifies misdemeanor offenses. Misdemeanors are most often punished with fines, even though imprisonment may be allowed under the code. Some penal provisions permit fines and imprisonment to be applied concurrently. The code provides for special security measures of indefinite duration for abnormal offenders and severe recidivists.
