The article provides a legal review of the penal regulations on distinguishing between right and wrong in criminal cases of persons not responsible for their actions, referencing laws from Colombia, Argentina, Chile, Spain, Germany, and Italy.
Abstract
Protective custody and involuntary commitment to protect these criminal types versus the public good are also reviewed. It is suggested that such cases in Colombia be treated by limitation of the punishment to no longer than that of what medical treatment might be or to return to the Colombian 1979 project limitations on security for such criminals. Note is also made of the inhumane treatment of such cases in Colombia. 45 notes
