THE SUPERVISORY JUDGE IN ITALY HAS SPECIAL JURISDICTION OVER THE EXECUTION OF PENALTIES AND SECURITY MEASURES (PREVENTIVE DETENTION AND OTHER RESTRICTIONS).
Abstract
HE IS OBLIGATED TO VISIT PENAL INSTITUTIONS, TO HEAR COMPLAINTS FROM PRISONERS AND GENERALLY TO OBSERVE THAT PRISONERS' RIGHTS ARE RESPECTED. HIS MAIN POWER IS TO ADVISE PRISON OFFICIALS AND TO REPORT TO THE MINISTRY. IN SECURITY MEASURES HE HAS GREAT POWER NOT ONLY TO ASSURE THEIR PROPER EXECUTION, BUT TO MODIFY AND REVOKE THEM. THE AUTHOR CONCLUDES THAT THE OFFICE IS ESSENTIAL, BUT THAT THE EXPERIENCE HAS BEEN DISAPPOINTING BECAUSE OF FAILURE TO ATTRACT APPROPRIATE PERSONNEL AND BECAUSE THE CASELOAD HAS BEEN TOO GREAT FOR PERSONAL KNOWLEDGE OF PRISONERS AND THOSE SUBJECT TO SECURITY MEASURES. --IN ITALIAN APPUNTI SUL GIUDICE DI SORVEGLIANZA
