THIS PROCEDURE, USUALLY SET BEFORE TRIAL AND AFTER ARRAIGNMENT, PROVIDES AN OPPORTUNITY FOR PRETRIAL MOTIONS AND OTHER REQUESTS TO BE CONSIDERED BY THE COURT AT ONE PROCEEDING WITH A MINIMUM OF FORMALITY AND FILINGS.
Abstract
THE OMNIBUS HEARING, IN ADDITION, ALLOWS THE COURT TO DISPOSE OF LATENT CONSTITUTIONAL ISSUES AND GIVES THE DEFENDANT THE OPPORTUNITY TO MAKE AN INFORMED DECISION AS TO HIS OR HER PLEA. THE OMNIBUS EXPERIENCE IN FLORIDA AND MISSOURI ARE DISCUSSED BRIEFLY. FEDERAL AND STATE JUDGES ARE URGED TO ADOPT THE USE OF THIS PROCEDURE IN THEIR OWN COURTS.
