RECOMMENDATION FOR A PROPOSED BILL WHICH WOULD ALLOW AN OFFICER TO ISSUE A WRITTEN SUMMONS IN LIEU OF IMMEDIATE ARREST.
Abstract
THE WRITTEN SUMMONS TO APPEAR IN COURT WOULD APPLY TO FELONY, MISDEMEANOR, AND CITY ORDINANCE VIOLATION CASES AND WOULD REPLACE ARREST AND INCARCERATION, SAVING MONEY FOR THE JAILS. OTHER RECOMMENDATIONS INCLUDED A SYSTEM WHERE THE ACCUSED IN ALL CASES COULD DEPOSIT IN CASH TEN PERCENT OF THE BAIL BOND TO BE REFUNDED IF HE APPEARS IN COURT AND A CONSTITUTIONAL AMENDMENT TO PROVIDE FOR BAIL FOR ALL OFFENSES, INCLUDING FIRST DEGREE MURDER AND TREASON.
