Oregon has enacted legislation that covers crime reporting by police agencies, criminal record confidentiality, criminal record expungement, access to and inspection of public records, and the Criminal Offender Information System.
Abstract
Police agencies are responsible for reporting crime information, particularly through the Bureau of Criminal Identification (BCI). The BCI is responsible for installing and maintaining systems that file and retrieve fingerprint data and supplemental information submitted by criminal justice agencies to identify criminal offenders. Legislation delineates requirements for maintaining criminal record confidentiality, accessing criminal records, and disseminating criminal record information. Legislative provisions also deal with expunging records, protecting the right of citizens to access public records, and protecting certain public records from unauthorized disclosure. Oregon's Criminal Offender Information System contains information on an individual's arrest record, the nature and disposition of criminal charges, sentencing, confinement, and release. Responsibility for maintaining and disseminating criminal offender information rests with the Oregon State Police. Amendments passed during Oregon's 1993 legislative session that affect criminal law and procedures are noted.
