TO IMPROVE THE CRIMINAL JUSTICE SYSTEM WE MUST FIRST UNDERSTAND IT AND THEN CEASE TO OVERBURDEN IT WITH UNNECESSARY TASKS.
Abstract
THE SYSTEM MUST NOT BE SEEN AS A NUMBER OF GROUPS OF INDEPENDENT SPECIALISTS, BUT AS A CIRCULAR CONTINUUM MADE OPERATIVE BY THE COMBINED EFFORTS OF POLICE, LAWYERS, COURTS, CORRECTIONAL WORKERS AND FACILITIES, AND THE LEGISLATURE. TO CEASE TO OVERBURDEN THE SYSTEM IT MUST BE DETERMINED WHAT THE REAL OBJECTIVE OF THE SYSTEM IS. IF IT IS THE PRACTICAL END OF PUBLIC SAFETY THOSE PRACTICES WHICH ARE CONCERNED WITH ATTAINING AN IDEAL OF MORALITY AND GOODNESS MUST BE DISCARDED. THE NEGATIVE APPROACH OF VENGEANCE AND PUNISHMENT MUST TURN TO THE PRACTICAL ONE OF DETERRENCE BY REFORMATION. (AUTHOR ABSTRACT)
