THIS REPORT DESCRIBES THE ACTIVITIES OF NEW YORK CITY'S PRDU - WHICH PROVIDES LEGAL, SOCIAL WORK, INVESTIGATIVE, AND PARAPROFESSIONAL SERVICES TO PAROLEES - AND DESCRIBES PAROLEES' REACTIONS TO THE PROGRAM.
Abstract
CREATION OF THE UNIT WAS IN RESPONSE TO COURT DECISIONS UPHOLDING THE CONSTITUTIONAL RIGHTS OF PAROLEES DURING PAROLE REVOCATION PROCEEDINGS. THIS REPORT INDICATES THAT THE PRDU HAS HAD LITTLE SUCCESS IN REPRESENTING CLIENTS AT PRELIMINARY HEARINGS. THE UNIT IS SAID TO HAVE BEEN MORE SUCCESSFUL AT INTERVENTION BETWEEN PRELIMINARY AND FINAL HEARINGS. AT FINAL HEARINGS, THE UNIT HAS WON SOME FORM OF PAROLE IN TWENTY-EIGHT PERCENT OF THE CASES IT HAS REPRESENTED, WHILE ONLY FOUR PERCENT OF UNREPRESENTED CASES WON PAROLE DURING THAT SAME TIME PERIOD. ALL PAROLEES INTERVIEWED SUPPORTED THE ACTIVITIES OF THE PRUD. THE UNIT IS SAID TO HAVE RAISED IMPORTANT QUESTIONS CONCNERNING PRELIMINARY HEARINGS, PAROLE CONDITIONS, AND PROPORTIONALITY OF PUNISHMENT TO PAROLE VIOLATION.
