After an introduction that describes the history, structure, and content of the Polish Penal Code, this book presents an English translation of the code.
Abstract
The current code, which took effect January 1, 1970, consists of a "General Part," a "Special Part," and a "Military Part." The General Part, which pertains to the general provisions of the criminal law, addresses the basis of penal liability; forms of commission of offenses; exclusion of penal liability; conditional discontinuance of the proceedings; penalties, kind, imposition, and rules for the execution of penalties; conditional suspension of the execution of the penalty; preventive measures; conditional release before expiration of the term; periods of limitation; expunction of sentences; glossary explaining the meaning of terms used in the code; and the relation of the code to special laws. The Special Part defines offenses under 18 offense classifications. The Military Part specifies offenses that may be incurred by military personnel. The code reflects the concept of socialist humanism. This not only involves the protection of the interests of the socialist State as a state, but also the guarantee of the conditions of cultural and economic development of society; it signifies the protection of social property, the economic basis of the State, and the protection of the rights and interests of each citizen. Appended provisions introduce the Penal Code and the Law of December 22, 1969 on the retention in force for a transitory period of some heretofore existing provisions of the penal law
