Judicial decisions which interpret the meaning of Western Australia's Police Act from 1892 through 1978 are explained for the benefit of the layperson.
Abstract
The Police Act has been used in its various forms since 1892 to define police structure, regulations, duties, powers, and laws bearing upon public order and safety. Major parts of the act deal with the appointment of officers and constables of the police force; the regulations, duties, and discipline of the police force; the Police Appeal Board; the appointment and regulation of special constables; Aboriginal police aides; the establishment of police districts; and the powers of the police and the apprehension of offenders. Other parts cover general provisions for offenses and penalties to be in force throughout the State, opium and dangerous drugs, provisions as to offenses applicable only where not the subject of municipal or other bylaw, and miscellaneous provisions. Each major part of the act is explained, and sections are interpreted according to judicial decisions bearing upon them. Appended are sections of the act that have been repealed, forms to be used in fulfilling various requirements of the act, and a list of prescribed drugs. A subject index is provided.
