Abstract
DISCUSSED ARE SUCH ASPECTS OF THE QUESTION AS THE NEED TO USE A FIREARM AT ALL, THE PROPER INTERPRETATION, IN THE SPECIFIC CASE, OF THE WEST GERMAN POLICE PRINCIPLE OF FITTING ACTION TO THE CIRCUMSTANCES, THE IMPLICATIONS OF THREATS TO EMPLOY FIREARMS, AND THE ENDANGERING OF INNOCENT BYSTANDERS. REFERENCES ARE PROVIDED TO THE APPLICABLE PROVISIONS OF WEST GERMAN LAW. IT IS MADE CLEAR THAT THE REASON FOR DISCUSSING THE QUESTION OF THE USE OF FIREARMS BY THE POLICE IS THE NEED FOR A CLEARCUT POLICY TO BE FOLLOWED BY POLICEMEN IN CONFRONTATIONS WITH TERRORISTS.
