Abstract
This book was written in an effort to fill a gap in the existing body of knowledge in the filed of policing and law enforcement. With the country’s roadways continuing to grow ever more congested, the countless legal and administrative issues inherent in police vehicular pursuits has never been more prominent. The book assembles the many findings of previous research in the area of vehicular pursuit and the resulting liability and negligence that often accompanies such operations. It provides a comprehensive examination of the legal aspects underlying police department pursuits and policy considerations; exploration of liability and negligence, including municipal liability, trainings, breach of duty, and deliberate indifference; State tort law, including intentional tort, public duty, contributing negligence, assumption of risk, and sudden peril; Federal liability law pertaining to police vehicular pursuits; the use of force involved in pursuits; and considerations of a national pursuit policy. The book is intended as a resource for professionals and students of criminal justice and law enforcement to better understand the intricate concepts in vehicular pursuit facing administrators and police officers in the field.
