The twofold purpose of this annotated manual is 1) to inform states about the core requirements they must meet to receive funding under the Juvenile Justice and Delinquency Prevention Act’s (JJDPA’s) Formula Grants Program and 2) provide states an example of how a state should demonstrate compliance with the core requirements and structure its compliance monitoring manual.
The manual’s section on “Compliance with the Core Requirements” of JJDPA addresses 1) the deinstitutionalization of status offenders (DSO); 2) the removal from adult facilities of juveniles prosecuted as adults; 3) the separation of juveniles from adult inmates; and 4) the removal of juveniles from adult jails and lockups. Another major section of the manual addresses “Elements of an Effective System of Monitoring.” This section addresses compliance monitoring policies and procedures, monitoring authority, violation procedures, adherence to federal definitions, identification of the monitoring universe, classification of the monitoring universe, inspection of facilities, and compliance data collection and verification. The manual’s concluding section addresses the “Compliance Monitoring Reporting Requirement.” It indicates the period that must be covered by the annual compliance monitoring report, as well as the submission of compliance data and supporting documentation.
