This report presents addresses and discussion summaries from a seminar on pretrial diversion for adult offenders sponsored by the Australian Institute of Criminology and attended by criminal justice and treatment professionals.
Abstract
Following reviews of the efforts of the Australian Institute of Criminology to introduce diversion programs into Australia's criminal justice systems and of adult offender pretrial diversion programs in other countries, papers focus on various aspects of pretrial diversion schemes. Issues considered include alternative mechanisms for managing the consequences of criminal offenses without contacting the criminal justice system, a theoretical critique of diversion, the rights of the accused under diversion schemes, New Zealand's sentencing innovations suitable for use in diversion programs, and issues in the establishment of a pretrial diversion program. Papers on specific types of diversion programs focus on heroin-using offenders and incest offenders. A pilot scheme for diversion programs in the Australian Capital Territory is proposed.
