TRANSFER OF PRELIMINARY RESEARCH FROM JUDICIAL LAW CLERKS TO A CENTRAL STAFF SHIFTS A SUBSTANTIAL PORTION OF THE RESEARCH FROM AFTER-TO-BEFORE ORAL ARGUMENT.
Abstract
A CENTRAL RESEARCH STAFF IS AN ALTERNATIVE TO MULTIPLE LAW CLERKS (IN EXCESS OF ONE CLERK PER JUDGE). THIS CENTRAL STAFF, USUALLY COMPOSED OF RECENT LAW SCHOOL GRADUATES, PERFORMS PRELIMINARY RESEARCH AND PREPARES PREHEARING REPORTS FOR THE USE OF JUDGES. THIS FUNCTION HAS PROVEN MORE EFFICIENT THAN POST-ARGUMENT RESEARCH BY INDIVIDUAL CLERKS. IN ADDITION, JUDGES ARE BETTER PREPARED FOR THE CASES WHEN ARGUED.
