THIS ARTICLE CONTAINS A CRITIQUE OF NON-INSTITUTIONAL TREATMENT MEASURES FROM A HISTORICAL AND SOCIO-POLITICAL POINT OF VIEW.
Abstract
THE AUTHOR REJECTS A FUNCTIONAL APPROACH TO NON-INSTITUTIONAL TREATMENT, WHICH REGARDS IT AS A WELL-ESTABLISHED PENAL FUNCTION, THE EFFECTIVENESS OF WHICH CAN BE INCREASED BY EXPANDING CORRESPONDING SERVICES. HE ADOPTS A HISTORICAL APPROACH WHICH, WITHOUT DENYING THE USEFULNESS OF NON-INSTITUTIONAL TREATMENT, TAKES A CRITICAL VIEW OF THE FUNCTIONING OF CRIMINAL JUSTICE, OF THE PENAL SYSTEM SERVING IT, AND FINALLY, OF TREATMENT IN GENERAL, PARTICULARLY NON-INSTITUTIONAL TREATMENT. THUS, THE DEVELOPMENT AND INCREASED USE OF PROBATION AND OTHER FORMS OF NON-INSTITUTIONAL TREATMENT ARE ANALYZED AND CRITICIZED IN RELATION TO SOCIAL, POLITICAL, AND CULTURAL CHANGES IN VARIOUS COUNTRIES. IT IS THE OPINION OF THE AUTHOR THAT NON-INSTITUTIONAL TREATMENT, AS WELL AS TREATMENT IN GENERAL, SHOULD NOT BE ABOLISHED BUT BE RE-THOUGHT IN LINE WITH SOCIO-POLITICAL CONSIDERATIONS SPECIFIC TO EACH COUNTRY AND LINKED WITH THEIR DEVELOPMENT.
