EXPLORATION OF THE CONFLICT BETWEEN THE PUBLIC'S RIGHT TO KNOW ABOUT THE ADMINISTRATION OF JUSTICE AND THE INDIVIDUAL'S RIGHT OF PRIVACY IN THE CONTEXT OF A MISSOURI LAW SEALING ALL NONCONVICTION CRIMINAL RECORDS.
Abstract
THIS COMMENT EXAMINES THIS DILEMMA BY ANALYZING THE COMPETING DEMANDS OF CRIMINAL HISTORY RECORD PRIVACY AND THE PREVENTION OF SECRECY WITHIN THE SYSTEM OF JUSTICE. THE FOCUS IS ON MISSOURI LAW AND THE CONSTITUTIONAL RIGHTS IT AFFECTS. BECAUSE OF THE ABSENCE OF JUDICIAL RESPONSE IN MISSOURI OR ELSEWHERE, CRITERIA FOR RESOLVING THIS CONFLICT ARE EXTRAPOLATED FROM THE BROADER CONFLICT BETWEEN THE RIGHTS OF PRIVACY AND FREEDOM OF THE PRESS AND ARE APPLIED TO THE PARTICULAR PROBLEMS OF SEALING LEGISLATION.
