The National Institute of Justice has funded a Phase II examination of pretrial release practices. While the final report is still in the draft stages, the following article is based on the findings that will be presented in the final Phase II report.
Abstract
The article centers on perhaps the key issue in pretrial release program practices: the recommendation presented to judicial officers at the bail setting hearing by the release program staff. What impact does that recommendation have on the actual release decision? What about 'neutral' positions adopted by some agencies? The response to these questions will surprise some and make interesting reading for all those involved in pretrial. (Publisher abstract)
