ANALYSIS OF THE JUDICIAL DECISION-MAKING PROCESS WITH REGARD TO THE CHARGING, SUBSEQUENT TRIAL, AND ADJUDICATION OF INDIVIDUALS ARRESTED FOR ROBBERY.
Abstract
THE PRINCIPAL DATA FOR THE STUDY WERE THE CASES INVESTIGATED BY THE ROBBERY DETAIL OF THE OAKLAND POLICE DEPARTMENT BETWEEN DECEMBER 20, 1971, AND MARCH 31, 1972. CHAPTER ONE DISCUSSES THE HANDLING OF THESE CASES BY THE POLICE. CHAPTER TWO ANALYZES THE CASES IN WHICH SUSPECTS WERE RELEASED, CHAPTER THREE THE HANDLING OF CHARGED CASES BY THE COURT, AND CHAPTER FOUR THE CASES IN WHICH SUSPECTS WERE ACQUITTED OR DISMISSED. CHAPTER FIVE COMPARES THE OAKLAND RESULTS WITH A GROUP OF CASES HANDLED BY THE LOS ANGELES DISTRICT ATTORNEY'S OFFICE. CHAPTER SIX DISCUSSES THE POLICY IMPLICATIONS OF THE STUDY, CHAPTER SEVEN SOME ISSUES OF EYEWITNESS IDENTIFICATION AND FAIRNESS, AND CHAPTER EIGHT, THE IMPACT OF SUPREME COURT CASES. THE FOCUS OF THE STUDY IS ON THE LARGE NUMBER OF CASES IN WHICH PERSONS ARRESTED FOR ROBBERY ARE RELEASED FROM CUSTODY WITHOUT BEING CHARGED. THE STUDY EXAMINES THE REASONS FOR RELEASE AND THE EXTENT TO WHICH THE RELEASED CASES REPRESENT INNOCENT PERSONS AS OPPOSED TO POSSIBLY GUILTY PARTIES WHO FOR SOME REASON CANNOT BE PROSECUTED.
