PREPARED TO AID IN THE TEACHING OF AN UNDERGRADUATE COURSE IN CRIMINAL LAW USING THE CASEBOOK PRINCIPLES OF CRIMINAL LAW, ACTUAL CASES APPROPRIATE TO THE TOPICS TREATED ARE USED TO STIMULATE STUDENT DISCUSSION.
Abstract
IT IS EMPHASIZED THAT THIS MANUAL DOES NOT PURPORT TO TEL THE INSTRUCTOR HOW TO TEACH A COURSE IN THE PRINCIPLES OF CRIMINAL LAW, HOWEVER, IT IS NOTED THAT THE MATERIALS PRESENTED WORK BEST WHEN USED AS A STIMULANT TO A DIALOGUE BETWEEN INSTRUCTOR AND STUDENT, RATHER THAN AS A BACKDROP FOR A MONOLOGUE BY THE INSTRUCTOR. THE FORMAT OF THE MANUAL PROVIDES THAT THE STUDENT READ THE ACTUAL APPELLATE CASE PROVIDED FOR CONSIDERATION UNDER EACH TOPIC OF LAW CONSIDERED IN ORDER TO LEARN AND BE ABLE TO CRITICIZE THE PRINCIPLES OF LAW PRESENTED. EACH MAJOR CASE OR SUBSTANTIAL EXTRACT FROM A BOOK OR ARTICLE IS SUMMARIZED AND FOLLOWED WITH AN EXPLANATION OF THE REASONS FOR INCLUDING THE PARTICULAR ITEM IN THE COURSE. IT IS BELIEVED THAT THE MANUAL CONTAINS CERTAIN USEFUL BACKGROUND MATERIAL WHICH SOME INSTRUCTORS MIGHT NOT OTHERWISE HAVE ACCESS TO BECAUSE OF THE UNAVAILABILITY OF A COMPLETE LAW LIBRARY. THE TOPICS CONSIDERED ARE AS FOLLOWS: PURPOSES AND LIMITS OF THE CRIMINAL LAW; A GENERAL VIEW OF THE CRIMINAL JUSTICE SYSTEM; MENTAL STATE; THE ACT REQUIREMENT; HOMICIDE: USING MENTAL STATE AND OTHER FACTORS TO CLASSIFY CRIMES; MENTAL STATE AND OTHER FACTORS TO CLASSIFY CRIMES; MENTAL DISEASE OR DEFECT; ALCOHOLISM AND ADDICTION: INTOXICATION; JUSTIFICATION AND EXCUSE; ATTEMPTS; CONSPIRACY AND SOLICITATION; AND PARTIES: LIABILITY FOR CONDUCT OF ANOTHER.
