A TEXTBOOK WHICH DESCRIBES THE CURRENT SENTENCING POLICIES OF THE BRITISH COURT OF CRIMINAL APPEAL, AND INCLUDES DISCUSSIONS OF THE DETERMINATION OF SENTENCE LENGTH, INDIVIDUALIZATION, AND SENTENCING PROCEDURES.
Abstract
THIS STUDY IS BASED PRIMARILY ON AN ANALYSIS OF EVERY DECISION ON AN APPEAL AGAINST SENTENCE BETWEEN JANUARY 1962 AND OCTOBER 1969. IT DESCRIBES THE GENERAL APPROACH OF THE COURT TO SENTENCING AND DEALS IN DETAIL WITH SENTENCES OF IMPRISONMENT AND THE USE OF ALL SPECIAL FORMS OF SENTENCE SUCH AS PROBATION, BORSTAL TRAINING, AND HOSPITAL ORDERS. ALSO DISCUSSED ARE THE POLICIES WHICH ARE EMERGING IN RELATION TO NEW FORMS OF SENTENCE INTRODUCED BY THE CRIMINAL JUSTICE ACT OF 1967, AND PROCEDURAL ASPECTS OF SENTENCING. THE AUTHOR STATES THAT THIS BOOK IS PRIMARILY INTENDED FOR PRACTITIONERS IN THE HIGHER COURTS IN ENGLAND AND STUDENTS OF SENTENCING, ALTHOUGH IT SHOULD BE OF INTEREST TO ALL THOSE CONCERNED WITH THE WAY IN WHICH APPELLATE REVIEW CAN BE A MEANS OF DEVELOPING MEANINGFUL PRINCIPLES OF SENTENCING.
